PBNU Urges Immediate Ratification of Revisions to the Mineral and Coal Law
PBNU decided to accept mining licenses because it considered the positive impact greater than the negative impact.
TEMPO.CO, Jakarta - The Executive Board (PBNU) has urged the Legislative Body (Baleg) of the House of Representatives to immediately ratify the Law on the Fourth Amendment to Law No. 4/2009 on and (Minerba Law).
PBNU Chairman Ulil Abshar-Abdalla said that in principle the provisions related to the allocation of Special Mining Business License Areas (WIUPK) to religious-based community organizations have been regulated through Government Regulation (PP) Number 25 of 2024. However, according to him, his party has been unable to execute it in detail because the legal umbrella is not yet available.
"We support that this revision be passed quickly because if not, there are maslahat (benefits) that are disturbed," said Ulil during a Public Hearing or RDPU with Baleg at the Nusantara I Building, on Wednesday, January 22, 2025.
According to Ulil, the passing of the Minerba Law gives the Supreme Court the basis for deciding on a judicial review of Government Regulation (PP) Number 25 of 2024 concerning the Implementation of Mineral and Coal Mining Business Activities. The Reject Mining Advocacy Team submitted the regulation for judicial review last October.
In addition, according to Ulil, every policy must have positive and negative impacts. In this case, PBNU decided to accept the mining license because it considered the positive impact greater than the negative impact.
"We see that the maslahat of this policy, namely mining concessions for religious organizations, is greater than the mafsadah (harm)," said Ulil.
The DPR Legislative Body previously agreed on the results of the drafting of the Mineral and Coal Bill or the Minerba Bill to become the DPR's initiative proposal on Monday, January 20, 2025. The Chairman of Baleg, Bob Hasan, knocked the hammer at exactly 23.15 WIB. Before knocking on the hammer, Bob first asked the meeting participants whether the results of the drafting of the Bill on the Fourth Amendment to Law Number 4 of 2009 concerning Mineral and Coal Mining could be processed further according to the statutory process.
"Accepted," all the meeting participants, who were from various factions, answered in unison at the Parliament Complex, Senayan, Jakarta.
In its content, Bob said the Bill on the Fourth Amendment to Law Number 4 of 2009 contained provisions for granting Mining Business License Areas (WIUP) by auction or priority to business entities, cooperatives, individual companies, civil society organizations, and universities.
In conclusion, Bob said the draft must be immediately continued and processed according to the law by involving public participation. "And from your input, the conclusion is that there must be an in-depth study involving public participation. We must counter related linguists, mining experts, and entrepreneurs listed in the law. Religious organizations and all those involved," he said.
